These Terms of Use ("Terms") apply between you as a user ("you" or "the user") and Gastrona ("we", "us" or "Gastrona") regarding the use of our mobile application, website and related services ("the Service").
By downloading, installing, registering for or using the Service, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree to the Terms, we ask you to refrain from using the Service.
1. License and usage rights
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for private, non-commercial use in accordance with these Terms. You may not use the Service for commercial purposes without written permission from us. You are responsible for any equipment, internet connection and related costs to be able to use the Service.
2. Age ratings, account eligibility and access
Please read this section together with our Age Suitability page at gastrona.app/age-suitability.
- App store age rating: Apple App Store, Google Play and similar platforms may display an age rating for Gastrona based on the presence of alcohol-related content in the app. That rating is a platform content classification. It does not mean that every person who can download the app is eligible to register for a Gastrona account.
- Account eligibility: Registration and use of account-based features require that you are 25 years or older. During registration you must confirm that you meet this requirement. We may refuse or terminate access if we reasonably believe this requirement is not met.
- Limited use without an account: Some parts of the Service may be accessible before registration. If you are not eligible for an account, you must not use account-based features or attempt to register.
3. User account and security
- Registration and authentication: Certain features require you to create an account by providing accurate information and authenticating via SMS, Google, Apple or Facebook.
- Security: You are responsible for protecting your login credentials and for all activity that occurs via your account. If you suspect unauthorized use, you must immediately contact us.
- Age confirmation: You must be 25 years or older to create an account. During registration you must actively confirm that you meet this age requirement. Providing false information is a breach of these Terms.
4. Subscriptions, payment and fees
- Subscription models: We offer both monthly and annual subscriptions. Subscriptions renew automatically unless cancelled in advance via your app store.
- Free trial period: New users may be offered a free trial period. If you do not cancel the service before the trial period expires, you will be automatically charged according to your chosen plan.
- Payment processing: All payments are processed by third-party providers (e.g. Apple, Google). We do not have access to your payment information. Check their terms for more information.
- Price changes: We reserve the right to change prices. You will be informed in advance and can choose to cancel your subscription before the change takes effect.
5. User restrictions
You agree not to:
- Use the Service for illegal, fraudulent or improper purposes.
- Publish or distribute offensive, threatening or harmful content.
- Copy, distribute, modify, reverse-engineer or otherwise misuse the app's code or content.
- Disrupt the Service's technical functionality or other users' experience.
- Attempt to circumvent security measures or improperly access our servers or systems.
6. Intellectual property
All content in the Service – including but not limited to text, images, graphics, design, logos, audio, video and software – belongs to Gastrona or our licensors and is protected by copyright, trademark and other intellectual property laws. Unauthorized use is prohibited.
7. User-generated content
If you choose to contribute content, e.g. reviews, images or feedback, you grant us a non-exclusive, global, royalty-free right to use, reproduce, display and distribute such content within the framework of the Service. You are responsible for ensuring that the content does not infringe third party rights or violate law.
8. Disclaimers
The Service is provided as is ("as is") without any express or implied warranties. We do not guarantee that the Service is free from interruptions, errors or viruses. Use is at your own risk.
9. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental or consequential damages, including but not limited to lost profits, data loss or loss of use. Our total liability shall not exceed the amount you actually paid to us during the last 12 months.
10. Termination and suspension
We reserve the right to, without prior notice, terminate or temporarily restrict your access to the Service in case of violation of these Terms or suspicion of improper use. You can terminate your use of the Service at any time by deleting your account in accordance with our data deletion instructions. Deleting your Gastrona account or uninstalling the app does not automatically cancel an active subscription purchased through Apple App Store or Google Play; you must cancel the subscription separately in your app store account settings.
11. Changes to Terms
We may update these Terms. We will notify you of significant changes via email, app notification or via our website. Continued use after the changes take effect means you accept them.
12. In-app content and optional marketing communications
- In-app product content: Gastrona provides wine and food pairing recommendations, educational information and related product features as part of the Service. This content is factual and pairing-oriented and is intended for eligible account holders.
- Optional marketing communications: Where permitted by law, we may send promotional communications about wine and alcoholic products via push notifications, email or other channels. Such communications are separate from core app functionality, are directed only to users who are 25 years or older, and are sent only where you have given appropriate consent or enabled the relevant communication settings.
- Your choices: You can manage notification and communication preferences in the app or by contacting us at hello@gastrona.app. Where consent is required, you may withdraw it without affecting your ability to use core pairing features, subject to applicable law.
13. Applicable law and dispute resolution
These Terms are governed by Swedish law. Disputes arising in connection with the Service or these Terms shall primarily be resolved through dialogue. If a solution cannot be reached, the dispute is decided in Swedish court, with Stockholm District Court as the first instance.
14. Force Majeure
We are not responsible for delays or failure to fulfill our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to war, natural disasters, pandemics, technical disruptions or other force majeure events.
15. Assignment of agreement
You may not assign your rights or obligations under these Terms to anyone else without our written consent. We reserve the right to assign these Terms to a subsidiary or in connection with a business transfer or merger.
16. Severability
If any provision of these Terms should be invalid or unenforceable, this shall not affect the validity or enforceability of other provisions. The invalid or unenforceable provision shall be replaced with a valid and enforceable provision that best achieves the original intention.
17. Waiver
Our silence or failure to invoke any right or provision in these Terms shall not be construed as waiving this right or provision. Any waiver of right or provision must be in writing and signed by us.
18. App Store terms
The Service is available via Apple App Store and Google Play Store. Your use of the Service is also covered by these platforms' respective terms of use. In case of conflict between these Terms and platform terms, the platform terms apply to the extent required by the respective platform's rules.
19. Updates and maintenance
- App updates: We reserve the right to update the Service to improve functionality, security or user experience. Some updates may be mandatory to continue using the Service.
- Maintenance downtime: We may need to perform planned or unplanned maintenance. For planned maintenance, we notify this in advance via the app or email.
- Version management: We do not support older versions of the app. Users are recommended to always use the latest version.
20. Technical requirements
To use the Service requires:
- A compatible mobile phone or tablet with iOS 14.0 or later, or Android 8.0 or later
- Internet connection with at least 1 Mbps speed
- At least 100 MB free storage space
- Camera to scan wine bottles (optional)
21. User feedback and bug reports
We encourage users to report bugs and provide feedback to improve the Service. You can do this by:
- Using built-in feedback features in the app
- Contacting us via email at hello@gastrona.app
- Using the bug reporting feature in the respective app store
22. Alcohol legislation and responsible communication
Gastrona follows applicable alcohol legislation and responsible communication principles, including Swedish alcohol marketing rules where relevant:
- Account-based access and wine-related marketing communications are directed only to persons who are 25 years or older.
- In-app content focuses on pairing utility and factual, educational information rather than consumption encouragement.
- We do not sell alcohol or facilitate alcohol purchases through the Service.
- We do not provide alcohol-related information in countries or to persons where this is prohibited.
- Availability of the Service and its content may vary by country.
23. User-generated content and recommendations
As a user of the Service:
- You are responsible for all content you contribute, including reviews and recommendations
- You guarantee that your content is accurate and not misleading
- We reserve the right to remove or edit content that violates our guidelines
- We are not responsible for incorrect information that users share
